  • U.S. District Court for District of NJ. Successfully defended our bank client (which had acted in the dual capacities of depositary bank and drawee bank) against claims based on forged endorsements and payment of items not properly payable.
  • Appellate Division, NJ Superior Court. Successfully (a) prosecuted bank’s claims for reimbursement under letter of credit reimbursement agreement and personal guarantees and (b) defended counterclaims based on various lender liability theories.
  • NY Court of Appeals. Took appeals through NY courts on issue of application of appearance of impropriety rule concerning conflicts in attorney representation.

In a separate but related federal court matter ultimately decided in the United States Court of Appeals for the Third Circuit, Meyner and Landis LLP successfully defended bank against claims that bank violated provisions of the Equal Credit Opportunity Act by allegedly improperly denying credit application on the basis of gender.

  • Law Division, NJ Superior Court. Successfully defended executor against demand to set aside will.
  • Law Division, NJ Superior Court. Successfully resisted probate of purported holographic will.

  • NJ Office of Administrative Law. Represented Fortune 500 company in energy deregulation litigation before the Office of Administrative Law (OAL) and the New Jersey Board of Public Utilities. Negotiated two comprehensive settlements leading to the opening of a competitive marketplace.
  • NJ Office of Administrative Law. Represented developer in contested administrative hearing with Department of Environmental Protection (DEP) over issuance of individual permit for major residential development, resulting in grant of wetlands permit.
