Foreign Investors Creating Employment in the United States

EB-5 immigrant investors must make a capital investment of $1,000,000 or more into a commercial enterprise in the United States and provide full-time employment to at least 10 U.S. workers. A qualifying commercial enterprise can include:

  • An alien investor establishing a new business
  • An alien investor purchasing an existing business that has been reorganized into a new business
  • An alien investor purchasing or investing in an existing troubled business enterprise and, in doing so, saving U.S. jobs that would have been lost

Additional criteria for obtaining an EB-5 immigrant investor visa includes demonstrating that investment capital is derived from legal conduct and engaging in management of the business on a daily basis or through the formation of business policies.

Considerably smaller capital investments of $500,000 into a designated regional center may also enable foreign investors to gain admission to the U.S. through an EB-5 immigrant investor visa pilot program.

In the current pilot program for investments made through designated regional centers, the investor may have less involvement in managerial duties than traditional EB-5 immigrant investors.
